Acceptance of Terms
Welcome to Trackify! Trackify is a Spotify Developer Application (SDA) owned and operated by Trackify, a company registered in the United Kingdom (“Trackify”, “we”, “us” or “our”). Trackify provides an online platform and services related to music streaming (collectively, the “Services”).
Amendments to the Terms
We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the Services thereafter. Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page from time to time so you are aware of any changes, as they are binding on you.
The Services are intended solely for users who are thirteen (13) years of age or older. Any use of the Services by anyone under thirteen (13) is strictly prohibited and in violation of these Terms. By using the Services, you represent and warrant that you are thirteen (13) years of age or older and that you agree to and abide by all of the terms and conditions of these Terms.
Use of the Services
The Services may be used for personal and non-commercial use only. You agree not to use the Services in any other manner or for any other purpose.
We may terminate or suspend your access to the Services at any time, for any reason, and without warning. We may, in our sole discretion, terminate or suspend your access to all or part of the Services for any reason, including, without limitation, breach of these Terms.
Your use of the Services is at your sole risk. The Services are provided on an "as is" and "as available" basis. We expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.
Limitation of Liability
In no event will Trackify be liable to you for any direct, indirect, incidental, special, consequential or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses, resulting from: (i) the use or the inability to use the Services; (ii) the cost of procurement of substitute goods and services; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the Services; or (v) any other matter relating to the Services.
These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.
